1. Duty of Confidentiality
The Client (LexLogik user) is bound by a strict duty of professional secrecy towards their clients. This duty is a core principle of the Irish legal profession, covering all information obtained in the course of a professional relationship.
LexLogik UG acts as a service provider assisting the Client's professional practice. We are contractually bound to maintain the same high standard of confidentiality as the Client. LexLogik UG maintains absolute secrecy regarding all data processed through our systems.
2. Scope of Data Access
LexLogik UG shall only access confidential information to the extent strictly necessary for technical processing and software maintenance. Our Zero-Retention Architecture ensures that data is processed in-memory and is not persistently stored. As both Ireland and Germany are within the EU, all data processing is fully compliant with the EU GDPR and the Data Protection Act 2018 (Ireland).
3. Engagement of Third Parties
LexLogik UG is authorised to engage employees or specialised sub-processors to fulfil the contract. All such parties are bound by written confidentiality agreements that mirror the strict requirements of the Irish legal profession's standards.
4. Regulatory Accountability and Sanctions
LexLogik UG is aware of the legal and regulatory framework governing the protection of secrets. While the Irish system relies on common law and statutory data protection, breaches are subject to:
- Civil Liability: Claims for Breach of Confidence or breach of contract.
- Data Protection Sanctions: Investigations and fines by the Data Protection Commission (DPC) under the Data Protection Act 2018.
- Professional Impact: We assist solicitors in meeting their obligations to the Legal Services Regulatory Authority (LSRA) by providing transparent and secure processing.
Our Promise to the Irish Legal Profession
LexLogik is designed to provide Irish firms with a sovereign alternative to global cloud providers:
- EU Data Sovereignty: Your data never leaves the European Economic Area (EEA). Our servers are located exclusively in Germany (Hetzner Online GmbH).
- Immunity to the US Cloud Act: As a German company using German infrastructure, we are not subject to the US Cloud Act. There is no risk of US government access to your sensitive files.
- Zero-Retention Paradigm: Document data exists only in volatile RAM during the analysis phase. Once the task is complete, the data is purged instantly and irrevocably.
- End-to-End Security: All transmissions are secured via TLS 1.3, and our infrastructure is managed according to ISO 27001 standards.
